1. Acceptance of Terms

By downloading, installing, or using ViralCloner ("the Software"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Software.

These Terms constitute a legally binding agreement between you and ViralCloner ("we," "us," or "our"). You must be at least 18 years old to use our services.

2. License Grant

2.1 Grant of License

Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to:

  • Download and install the Software on devices you own or control
  • Use the Software for personal or commercial purposes
  • Access premium features according to your subscription plan

2.2 License Restrictions

You may NOT:

  • Copy, modify, or distribute the Software
  • Reverse engineer, decompile, or disassemble the Software
  • Rent, lease, or lend the Software to third parties
  • Remove or alter any proprietary notices
  • Use the Software to violate any laws or third-party rights
  • Share your license key or account with others
  • Circumvent any license validation mechanisms

2.3 Device Limitations

Your license allows activation on a limited number of devices based on your subscription plan. Exceeding this limit will result in automatic deactivation of older devices.

3. Account Registration

To use certain features, you must create an account. You agree to:

  • Provide accurate, current, and complete information
  • Maintain and update your information as needed
  • Keep your password secure and confidential
  • Accept responsibility for all activities under your account
  • Notify us immediately of any unauthorized access

We reserve the right to suspend or terminate accounts that violate these Terms or engage in suspicious activity.

4. Subscriptions & Payments

4.1 Free Plan

The free plan provides limited access to the Software's features. Free plans may be modified or discontinued at our discretion.

4.2 Paid Subscriptions

Paid subscriptions are billed on a monthly basis. By subscribing, you authorize us to charge your payment method automatically each billing cycle until you cancel.

4.3 Pricing Changes

We may change subscription prices with 30 days' notice. Price changes will take effect at the start of your next billing cycle after the notice period.

4.4 Cancellation

You may cancel your subscription at any time from your account settings. Cancellation takes effect at the end of your current billing period. No prorated refunds are provided for partial months.

4.5 Refunds

Refunds are handled according to our Refund Policy. We offer a 7-day money-back guarantee for first-time subscribers.

5. Acceptable Use

You agree to use ViralCloner responsibly and in compliance with:

  • All applicable local, state, national, and international laws
  • The terms of service of any third-party platforms you connect (Pinterest, Facebook, etc.)
  • The terms of service of AI providers (OpenAI, Anthropic, etc.)
  • Intellectual property rights of content creators

6. Prohibited Activities

You may NOT use ViralCloner to:

  • Spam, harass, or send unsolicited messages
  • Create or distribute malicious content
  • Infringe on copyrights, trademarks, or other intellectual property
  • Scrape or collect data in violation of platform terms
  • Engage in fraud, phishing, or deceptive practices
  • Distribute illegal content or promote illegal activities
  • Impersonate others or create fake accounts
  • Interfere with the operation of our services or others'
  • Access accounts or data without authorization
  • Violate any platform rate limits or automation policies

Violation of these prohibitions may result in immediate termination of your account without refund.

7. Third-Party Services

ViralCloner integrates with third-party services including but not limited to:

  • Social media platforms (Pinterest, Facebook)
  • AI providers (OpenAI, Anthropic, Google, Midjourney)
  • Payment processors (Stripe)

Your use of these services is subject to their respective terms. We are not responsible for:

  • Changes to third-party APIs or services
  • Account suspensions or bans by third-party platforms
  • Data processing by third-party services
  • Costs incurred from third-party API usage

8. Intellectual Property

8.1 Our Property

ViralCloner, including its code, design, features, and documentation, is our exclusive property protected by copyright and other intellectual property laws.

8.2 Your Content

You retain ownership of content you create using ViralCloner. However, you are responsible for ensuring you have the rights to use any source content in your workflows.

8.3 Feedback

If you provide feedback or suggestions, you grant us the right to use them without compensation or attribution.

9. Disclaimers

THE SOFTWARE IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND.

We disclaim all warranties, express or implied, including but not limited to:

  • Warranties of merchantability and fitness for a particular purpose
  • Warranties that the Software will be error-free or uninterrupted
  • Warranties regarding third-party service availability
  • Warranties that your social media accounts will not be affected

You use the Software at your own risk. We do not guarantee any specific results from using ViralCloner.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

  • We shall not be liable for any indirect, incidental, special, consequential, or punitive damages
  • Our total liability shall not exceed the amount you paid us in the 12 months preceding the claim
  • We are not liable for any loss of data, profits, or business opportunities
  • We are not liable for actions taken by third-party platforms against your accounts

11. Termination

We may terminate or suspend your access to ViralCloner immediately, without prior notice, if you:

  • Violate these Terms of Service
  • Engage in fraudulent or illegal activity
  • Fail to pay subscription fees
  • Abuse our services or support resources

Upon termination:

  • Your license to use the Software is revoked
  • You must uninstall all copies of the Software
  • We may delete your account data after 30 days
  • Any pending payments remain due

12. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which ViralCloner operates, without regard to conflict of law principles.

Any disputes arising from these Terms shall be resolved through binding arbitration, except where prohibited by law.

13. Changes to Terms

We reserve the right to modify these Terms at any time. We will provide notice of material changes by:

  • Posting the updated Terms on our website
  • Sending an email to registered users
  • Displaying a notice in the Software

Continued use of the Software after changes constitutes acceptance of the new Terms.
